Terms of Sale

These Terms of Sale govern the purchase of digital products from the Inkers website. Please read them before placing an order. By completing a purchase you accept these Terms.
1. Seller
Inkers S.A.S., a société par actions simplifiée, with registered office at 154 rue de Fresnes, 78630 Orgeval, France, registered under SIREN 892841420, intra-community VAT number FR28892841420.

2. Products
Inkers sells digital products for use in illustration and tattoo design software, including brush packs, stamps, typography and three-dimensional models. Products are supplied as downloadable files. No physical goods are shipped.
The essential characteristics of each product, including its price, are shown on its product page before the order is placed.
3. Orders
An order is placed by selecting a product, providing an email address, accepting these Terms and completing payment. The contract is formed when payment is confirmed. A confirmation email is then sent to the address provided, containing the product name, the amount paid, an order reference and a download link.
The buyer is responsible for the accuracy of the email address provided. That email is the buyer's record of purchase.
4. Prices and taxes
Prices are displayed in the currency shown on the product page and are inclusive of applicable taxes. The applicable tax is determined by the buyer's country and is shown separately on the receipt.
Prices may be changed at any time. The price applicable to an order is the price displayed at the time the order is placed.
5. Payment
Payment is processed by Stripe Payments Europe, Ltd. Card details are collected and processed by Stripe and are neither received nor stored by the Seller.
The order is fulfilled only after payment has been confirmed by the payment provider.
6. Delivery
Delivery is immediate and by download. After payment is confirmed, a download link is displayed on the order confirmation page and sent to the email address provided.
The download link is time limited. It remains valid for twenty-four (24) hours from issue. Once a download has begun, the link remains usable for thirty (30) minutes so that an interrupted transfer can be completed or retried. The link ceases to function after that period.
These limits exist to prevent redistribution of the files and do not limit the buyer's rights under this contract. A buyer who has not obtained the file may request a replacement link at support@inkers.app, quoting the order reference.
7. Right of withdrawal
In accordance with Article L221-28, 13° of the French Consumer Code and Article 16(m) of Directive 2011/83/EU, the right of withdrawal does not apply to the supply of digital content not supplied on a tangible medium where performance has begun with the consumer's prior express consent and acknowledgement that the right of withdrawal is thereby lost.
Before payment, the buyer is required to give express consent to immediate delivery and to acknowledge the loss of the right of withdrawal. That consent is recorded against the order.
Consequently, no right of withdrawal applies once the download has been made available to the buyer.
8. Refunds
Subject to Article 10, and given the immediate delivery of digital content and the consent given under Article 7, orders are not refundable once the download has been made available.
This does not affect the buyer's rights under the legal guarantee of conformity or in respect of hidden defects, as set out in Article 10.
9. Licence of use
Subject to full payment, the Seller grants the buyer a personal, perpetual, worldwide, non-exclusive and non-transferable licence to use the purchased files for the creation of artwork, including artwork produced, sold or applied in the course of the buyer's professional activity.
The licence is granted to a single named person. It does not extend to a studio, team or organisation.
The buyer may not:
- redistribute, sell, rent, lend, sublicense or otherwise make the files available to any third party, whether or not for consideration;
- include the files, in whole or in part, in any other product, asset pack, library or collection;
- make the files available on any file-sharing, cloud-sharing or public repository service;
- share the download link, the account or the files with any third party;
- reverse engineer, decompile or attempt to derive the source assets other than as permitted by mandatory law.
Artwork created using the files is the property of the buyer and may be used without restriction, including commercially. All intellectual property rights in the files themselves remain with the Seller.
Breach of this Article terminates the licence automatically.
10. Guarantees and liability
10.1 Legal guarantees
The buyer benefits from the legal guarantee of conformity provided by Articles L217-1 et seq. of the French Consumer Code, which applies to digital content, and from the guarantee against hidden defects provided by Articles 1641 et seq. of the Civil Code.
The following notice is reproduced in the form prescribed by law and is set apart from the remainder of these Terms:
Le consommateur dispose d'un délai de deux ans à compter de la fourniture du contenu numérique ou du service numérique pour obtenir la mise en œuvre de la garantie légale de conformité en cas d'apparition d'un défaut de conformité. Durant un délai d'un an à compter de la date de fourniture, le consommateur n'est tenu d'établir que l'existence du défaut de conformité et non la date d'apparition de celui-ci.
La garantie légale de conformité emporte obligation de fournir toutes les mises à jour nécessaires au maintien de la conformité du contenu numérique ou du service numérique.
La garantie légale de conformité donne au consommateur droit à la mise en conformité du contenu numérique ou du service numérique sans retard injustifié suivant sa demande, sans frais et sans inconvénient majeur pour lui.
Le consommateur peut obtenir une réduction du prix en conservant le contenu numérique ou le service numérique ou il peut mettre fin au contrat en se faisant rembourser intégralement contre renoncement au contenu numérique ou au service numérique, si :
1° Le professionnel refuse de mettre le contenu numérique ou le service numérique en conformité ;
2° La mise en conformité du contenu numérique ou du service numérique est retardée de manière injustifiée ;
3° La mise en conformité du contenu numérique ou du service numérique ne peut intervenir sans frais imposés au consommateur ;
4° La mise en conformité du contenu numérique ou du service numérique occasionne un inconvénient majeur pour le consommateur ;
5° La non-conformité du contenu numérique ou du service numérique persiste en dépit de la tentative de mise en conformité du professionnel restée infructueuse.
Le consommateur a également droit à une réduction du prix ou à la résolution du contrat lorsque le défaut de conformité est si grave qu'il justifie que la réduction du prix ou la résolution du contrat soit immédiate. Le consommateur n'est alors pas tenu de demander la mise en conformité du contenu numérique ou du service numérique au préalable.
Dans les cas où le défaut de conformité est mineur, le consommateur n'a droit à l'annulation du contrat que si le contrat ne prévoit pas le paiement d'un prix.
Toute période d'indisponibilité du contenu numérique ou du service numérique en vue de sa remise en conformité suspend la garantie qui restait à courir jusqu'à la fourniture du contenu numérique ou du service numérique de nouveau conforme.
Les droits mentionnés ci-dessus résultent de l'application des articles L. 224-25-1 à L. 224-25-31 du code de la consommation.
Le professionnel qui fait obstacle de mauvaise foi à la mise en œuvre de la garantie légale de conformité encourt une amende civile d'un montant maximal de 300 000 euros, qui peut être porté jusqu'à 10 % du chiffre d'affaires moyen annuel (article L. 242-18-1 du code de la consommation).
Le consommateur bénéficie, en outre, de la garantie légale des vices cachés en application des articles 1641 à 1649 du code civil, pendant une durée de deux ans à compter de la découverte du défaut. Cette garantie donne droit à une réduction de prix si le contenu numérique ou le service numérique est conservé ou à un remboursement intégral contre renonciation au contenu numérique ou au service numérique.

Where a product does not conform, the buyer may require it to be brought into conformity at no cost. Where that is impossible or cannot be done within a reasonable period or without significant inconvenience to the buyer, the buyer may obtain a price reduction or termination of the contract and a refund.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any liability that may not lawfully be excluded or limited.
10.2 Extent of the Seller's obligations
The Seller undertakes that the files supplied correspond to their description on the product page and are usable in the software and versions stated there.
The Seller does not warrant that the files are compatible with every version of every application or with every device, beyond the versions stated on the product page, nor that any particular artistic result can be achieved.
The versions against which products are tested are stated on each product page.
10.3 Limitation of liability
Subject to Article 10.1, the Seller is not liable for:
- indirect or consequential loss, including loss of profit, loss of clients, loss of commissions, loss of time or loss of business opportunity;
- loss or corruption of the buyer's own work, files or data, the buyer being responsible for maintaining backups;
- the unavailability or malfunction of third-party software, platforms, app stores, payment providers or internet connections;
- temporary unavailability of the website or of the download infrastructure, provided a replacement download link is issued upon request.
Where liability may lawfully be limited, the Seller's total liability in respect of any order is limited to the amount paid for that order.
10.4 Use of artwork
The Seller is not responsible for artwork created by the buyer using the files, nor for tattoos applied using such artwork, nor for any claim arising from them. Responsibility for a tattoo lies with the person who applies it.
11. Personal data
The email address provided at checkout is collected in order to deliver the order, to send the confirmation and receipt, and to provide support. It is not used for marketing unless the buyer has separately opted in.
Order records are retained for the periods required by accounting and tax law.
The buyer may exercise rights of access, rectification, erasure, restriction, portability and objection by writing to support@inkers.app. Erasure of personal data does not affect the retention of financial records required by law.

12. Support
Support is available at support@inkers.app. Requests should quote the order reference shown in the confirmation email, in the form INK-XXXX-XXXX.
13. Force majeure
The Seller is not liable for any failure to perform caused by an event of force majeure within the meaning of Article 1218 of the Civil Code.
14. Governing law and disputes
These Terms are governed by French law. This does not deprive a consumer of the protection afforded by mandatory provisions of the law of their country of habitual residence.

15. Amendments
The Seller may amend these Terms. The version applicable to an order is the version published at the time the order is placed.
16. Severability
If any provision of these Terms is held to be void or unenforceable, the remaining provisions remain in force.
